The Kitchen

These terms are an agreement between you and Chestnut Place, LLC ("The Kitchen," "we," "us") covering your use of The Kitchen iPhone app and the website at getthekitchen.app (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. What The Kitchen is
The Kitchen is a voice-guided cooking companion. You save recipes — by importing them from links, photos, or videos, or by choosing from recipes we feature — and a companion talks you through cooking them, answering questions and adjusting along the way. The companion's responses are generated by artificial intelligence and are not written or reviewed by a person in real time.
2. Who can use it
You must be at least 13 years old to use The Kitchen. If you're under 18, you need a parent or guardian's permission, and they agree to these terms on your behalf. You must be able to form a binding contract where you live. The Kitchen is currently offered in the United States and Canada.
3. Your account
You need an account to use the app. You're responsible for keeping your sign-in credentials secure and for everything that happens under your account. Tell us right away if you think someone else has accessed it. You may only create one account for yourself, and accounts cannot be shared. You can delete your account at any time from Account → Delete account in the app; deletion is permanent and removes your recipes and history.
4. Free beta and future pricing
The Kitchen is currently free while in beta. During this period we will limit usage to ten cooking sessions per day per user. If you hit this limit you will receive a notification in the app. We expect to introduce paid subscriptions in the future. If we do, we'll give you clear notice before anything changes for you, and any purchase will go through Apple's in-app purchase system under Apple's terms. There are no in-app purchases in the app today.
5. Cooking guidance, food safety, and allergies — please read this
The Kitchen's companions generate cooking guidance with AI. As with any technology, they can make mistakes. They may misread a recipe, misstate a temperature or time, suggest a substitution that doesn't work, or miss an ingredient. You are responsible for your own safety and the safety of anyone you cook for. In particular:
Food safety. Always use your own judgment and a thermometer for safe internal temperatures for meat, poultry, seafood, and eggs. Follow safe handling and storage practices regardless of what the companion says.
Allergies and dietary restrictions. The Kitchen does not know your allergies or medical needs unless you tell it. Even if you do, it can still get this wrong. Do not rely on the companion to confirm that a recipe or substitution is safe for an allergy, intolerance, or medical condition. Always check ingredients yourself.
Kitchen safety. The companion cannot see your kitchen. Use care with heat, knives, and appliances, and supervise children.
Not professional advice. Nothing in the Service is medical, nutritional, or dietary advice.
Imported recipes are turned into structured steps by AI and may contain errors introduced in that process. Featured recipes come from third-party creators and reflect their methods, not ours.
6. Recipes and other content
Content you import or create
You keep ownership of anything you add to The Kitchen — recipes you import, edits you make, and what you say to your companion ("Your Content"). You give us a license to store, process, display, and transmit Your Content as needed to run the Service for you (including sending it to the AI and speech providers described in the Privacy Policy), and to use it in aggregated or de-identified form to understand and improve the Service. This license ends when you delete the content or your account, except for de-identified data and copies in routine backups for a limited time.
When you import a recipe from a website, video, photo, or another app, you're making a copy for your own personal, non-commercial cooking use. You're responsible for having the right to do that. Don't import content you know you're not allowed to copy, and don't use The Kitchen to republish or redistribute other people's recipes. If you're a recipe author and believe your work appears in The Kitchen in a way that infringes your rights, email us at hello@getthekitchen.com and we'll respond promptly.
Featured recipes
Recipes we feature in the app (for example in Get Inspired) are attributed to their creators and link back to the original source. They're provided for your personal cooking use. Creators retain their rights; we don't claim ownership of their recipes.
Our content
The Kitchen app, its design, companion characters (Olive, Graham, Hazel, and Clove), their voices and personalities, the website, and all software are owned by us or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable license to use the app on Apple devices you own or control, as allowed by these terms and Apple's App Store rules. You may not copy, modify, distribute, sell, reverse-engineer, or make derivative works of the app or its content, or use the companions' names, voices, or likenesses outside the app.
AI-generated content
Companion responses are generated for you in the moment. To the extent we hold rights in them, you may use them for personal purposes. We don't guarantee they're unique — another user may receive similar or identical responses.
7. Acceptable use
Don't use the Service to:
Break the law or anyone's rights
Try to get the companions to produce harmful, hateful, sexual, or otherwise inappropriate content, or to act outside their cooking purpose
Probe, scrape, overload, or interfere with the Service or its infrastructure, or access it by any means other than the app we provide
Circumvent usage limits, authentication, or any other controls
Impersonate anyone or misrepresent your relationship with The Kitchen
Build a competing product using data or outputs from the Service
8. Third-party services
The Kitchen relies on third parties to work — Apple (speech recognition, sign-in, distribution), Google (authentication, database, AI models), ElevenLabs (voice synthesis), and others described in our Privacy Policy. Their availability and terms are outside our control, and a change on their side may affect the Service. Links to third-party websites (like the original source of a recipe) are provided for convenience; we're not responsible for their content.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty that the Service will be accurate, reliable, uninterrupted, or error-free. This is a beta product built by a very small team; things will break sometimes, and features may change or be removed without notice. Some jurisdictions don't allow certain warranty disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent the law allows, The Kitchen and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of or inability to use the Service — including any injury, illness, allergic reaction, property damage, or loss resulting from following cooking guidance provided through the Service. Our total liability to you for any claim arising from the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or $50 (USD). Some jurisdictions don't allow these limits, so they may not fully apply to you.
11. Indemnity
You agree to defend and hold us harmless from claims and expenses (including reasonable legal fees) arising from Your Content, your violation of these terms, or your violation of any law or third-party right in connection with the Service.
12. Ending things
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, if we're required to by law, or if we discontinue the Service. If we discontinue the Service, we'll try to give you reasonable advance notice. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) do.
13. Apple-specific terms
Because you download The Kitchen from the Apple App Store, the following also applies. These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal requirements, or consumer protection claims, or for the investigation, defense, or settlement of any third-party intellectual property claim. You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and are not on any U.S. government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms as the Service evolves. If a change is material, we'll notify you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the new terms. The "Last updated" date at the top shows the current version.
15. Governing law and disputes
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in North Carolina, and you consent to their jurisdiction. If you're a consumer in a jurisdiction that gives you the right to bring claims in your local courts or under your local law, nothing here takes that away.
16. General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a provision, that isn't a waiver. You may not transfer these terms; we may transfer them in connection with a merger, acquisition, or sale of assets. These terms are written in English; if we provide a translation, the English version controls.
